1. Data Collection

When registering with Generation-X.net (hereinafter GenX) and creating their own user profiles, users enter personal data, such as e-mail addresses, date of birth, gender and place of residence. These personal user data are handled by GenX in strict confidence according to statutory provisions; during the term of the agreement, the data will only be collected, processed and used for the purposes of executing the agreement, unless the user expressly consents to other uses. The data are collected, used and processed electronically.

2. Personal Data

“Personal data” are individual statements of information on the personal or material circumstances of a certain or identifiable natural person. Personal data, therefore, allow for specific natural persons to be identified.

3. User Profile and Sharing of Information within the Community

Following registration with GenX, the user can create and design his or her own profile. User-profile information, such as the username, the profile picture, display of the place of residence as well as videos and images uploaded to public folders, can be seen on the platform, including by non-registered visitors to the platform.

In addition, within his or her network of friends and groups, the user can exchange information with other GenX users. Using the privacy settings, the user can decide which information he or she wishes to share with friends or groups. The user's actions will be documented according to his or her privacy settings – for example, contacting or adding a new friend, the number of photos or videos uploaded, or comments or reviews he or she has posted on certain images and/or videos. Such information is called newsfeeds. These newsfeeds are displayed within the user’s circle of friends, which he or she can define, as well as within the groups that the user joins. In the case of groups, for example, newsfeeds alert members of a certain group that a new post has been published to the forum. The user can limit the amount and extent of the information exchanged by adjusting the settings as needed. Through his or her own network and privacy settings, it is, therefore, the user who decides which other users can read his or her newsfeeds, particularly as he or she creates his or her own circle of friends and decides which groups to join. In addition, the user will find in his or her profile user-specific newsfeeds that display the activities and types of actions recently taken by the user. These user-specific newsfeeds can be disabled, if the user so wishes, using the privacy settings.

4. Use of Data

GenX will pass data on to a third party only if this is required for statutory or legal reasons and/or if this is required to provide the user with, and implement, the services of the platform and/or if GenX has the user's express consent to do so.

GenX is authorised to pass information on to a third party if such third party is to provide services or carry out actions on behalf of GenX, such as running the platform software on external servers or processing and settling payment transactions for products or services offered.

During the term of the agreement, GenX may send the user a newsletter with material, for example, on support, technical advice and other information regarding the services utilised by the user, any options for expansion and other information regarding the operation of the GenX platform. Each newsletter will contain a link that will allow the user to cancel his or her subscription to the newsletter at any time.

GenX shall be entitled to collect, process and use the user's master and connection data for the purposes of identifying, delimiting and removing malfunctions and errors in the telecommunications systems. If the corresponding requirements are met, GenX may collect, process and use the master and connection data that are necessary to uncover any unlawful use of the telecommunications systems and services. Under the applicable provisions, GenX shall provide information to prosecuting authorities and courts of law for the purposes of criminal prosecution. If requested by the user, GenX shall inform the user, free of charge and immediately, about such data as are stored in respect of his or her person or pseudonym. If so requested by the user, such information may also be provided electronically. Furthermore, GenX shall not share the user's data or the content of the user's private messages with any third party unless the user consents thereto.

GenX instructs the user in express terms that his or her privacy and the protection of his or data regarding data transmissions via open networks such as the Internet cannot be guaranteed in full under the current state of technology. The user understands and acknowledges that the provider can view, in technical terms, the pages stored on the web server and, perhaps, other user data stored on such server at any time. The user shall be fully responsible for ensuring that the data that he or she transmits through the Internet and stores on web servers are protected and secure.

5. Cookies

Following the user's registration, GenX uses cookies with which the user will be identified during his or her visits to the platform and which allow the user to be recognised after logging on to the platform. Such cookies will be stored on the user's computer. Using the settings of his or her computer, the user can remove such cookies or disable the use of cookies.

6. Application of Privacy and Data Protection Provisions

GenX shall be entitled to amend this Privacy Statement subject to the applicable privacy provisions under law. GenX shall identify and communicate any such amendment on its platform. The user may object to such amendment within 14 days in writing. E-mail communications shall satisfy the requirement of written form. In such event, GenX may terminate the provision of services to the user.
